So I'm being serious, can I really not have outdated flairs on the boat? Seems if  I have current the out dated are merely a back up. Confused now!

There is no law that says that you cannot have outdated ones on board, but your valid ones have to be separate (in a different container) from the old ones so no mix up can occur. If anybody fines you for having outdated legal materials on board of your property , do not pay the fine.Go to court because the judge will throw that ticket in the garbage together with all the other citations you may have been given by an ignorant over eager officer.

Sacrificing personal freedom on the alter of  ""safety"".. ask  the venezuelans  how that worked out for them..   Big brother will take care of everything.. Surveillance is a GOOD thing.

I agree that aggressive law enforcement and tickets are no fun, but seeing drunken sailors with on very busy bays causing bodily damage and children having to be med-evacued because of daddies stupid drunken decisions is definitely a worse alternative. As for Venezuela and its troubles , let's leave that out of this because there are a ton of things that have nothing to do with our situation. It may be that you hark back for a time when there were only half as many people around and there was more room to do your own thing without regulations

The CG and CG Auxillary and the SP have told me that you are encouraged to carry outdated signaling devices (flares) as back ups. Just make sure you gave at least 3 unexpired flares on board if someone got a ticket for having extra flares on board , they better plead not guilty and head for court and also file a complaint with the issuing agency. Someone is mis informed

True ,more traffic in day time, more tickets. Night  good luck.. I worked patrol boat for sheriffs office years ago, our job was education on lake 80%,  20% tickets. Many people have no clue how to properly operate boat, or launch. A 80 year old who never had a boat can purchase a 40 ft and go out onto a lake. Education not by tickets, alcohol evolvement arrest. Oh you vote for your county Sheriff,  NYC elects Coumo.

  The ticket for outdated flares was given to a member of Noreast.com, a very large saltwater forum for LI, SI and coastal NY/NJ that I am a member of...  He shared it earlier this year.. It was not given upstate, but on coastal NY waters. Not sure if he appealed it, but i would have.
    I have a feeling it was given by an officer that may not have understood the regulations very well..

 From what I understand, you certainly can have out dated flres, as long as you also have compliant ones aboard.
  What many here do not seem to understand is that a LOT of officials that are patrolling the water, are NOT specifically trained to be on the water, especially here in upstate.. Coastal zones are more likely to have full time patrols.. Up here they will be mostly gone after Labor day.

 These are NOT Marine law specialists, and the membership here probably has a lot more knowledge and experience in marine law  than the 25 year old kid that might write a ticket.. 

Downstate. there are TONS of problems because local,county and state marine patrols also issue tickets for undersize fish, and bag limits, along with the separate DEC patrols.. There are many mistakes.   Many reports  on the salt water fishing  sites from irate angles ticketed for short Fluke[Summer Flounder], when in reality the guys had Windowpane flounder or 4Spot Flounder, both of which are somewhat similar, but are NOT regulated in size or in bag limit.. Yes NY state DOES allow non DEC personal to check bag and size limits downstate, each and every day.. My flares are out of date now for 5 years. they still work. if I took my boat out on the great lakes and the coastguard saw them I probably get a ticket. Seneca and Cayuga lakes are connected to the great lakes system. that means the rules apply here too. do they enforce it i haven't seen them do it yet. I don't think the state police are concerned about out of date flares on the finger lakes. what they look for is drunk boaters, boat speed and firearms on your boat. if you want to use flares on the finger lake get them. its boat safety. i;m going to get new flares soon. i'm overdue for a trip out on lake Erie. watch your drinking out on these lakes. the police know we have a drinking and drug problem with our society.

I was surprised the Coast Guard didn't even check the date of my flares when I was stopped. 

That was an oversite in the coastie’s part. He should have. Expired flares will get you a ticket and perhaps a trip back to the dock. End of voyage for the day

I spend quite a bit of time on cayuga and never had a problem. At least once a year I'll get checked but it's always been dec and they're always super cool so long as your behaving. Any time someone gets a bs ticket it's worth fighting in court that's what courts are there for that being said the last one I fought and judge threw out go figure they still tried making me pay the mandated surcharge which is almost always as much if not more than the ticket. I laughed and left and never heard another word about it but that part is a total money grab crazy amount of money state and local jurisdictions bring in and always seem to be out of funds

I think this is where there is a lot of confusion. We are dealing with two separate governing entities. The NY state DEC has rules and regulations that are separate ( but can’t supersede ) the federal CG rules and regulations. NY regs state that you must carry a daytime signaling device ( flag , etc . ) but the CG could care less about a flag so the DEC or the Sherriff or troopers may ask for it , but the CG won’t. They never said it was going to be easy Lol

A definite alternative. But for nighttime signaling only. You still need a daytime signaling device. Flag or flares most electronic devices come with a flag in a kit

DEC writes out a ticket, your guilty.  you go to court and the judge ask you, how do you plead, you say innocent the judge ask you do you have a lawyer you say no. judge will tell you 200 dollar fine. pay it or bend over. some of you guys here watch to much fake news.  DEC writes out a ticket. you gave him rope. he will hang you with it.

I obey the law. I know the system. I never had a violation in my 60 years of fishing. the law today is rotten to the core. its controlled buy the special interest runned by the far left media and our communist democratic party. these rotten bastards are out to suck the little guy dry with laws that make life harder for us. these people that make these laws     are a bunch of criminals that steal from the system night and day and get away with everything they do. we do some foolish they hang us. I see you are one of the far left.

Two weeks ago the wife and I went up to the Adirondacks for a 9 day camping trip. all the years. I have use a truck camper to camp and fish. I never been pulled over for anything. police pulled me over for a safety check. they ask if I had my propane on to run the fridge. I said no.  they check it walked around the truck found no violations. like i said in my above post the police are cracking down all over.  people with RV and motor homes watch yourself. make sure you have your propane off when you are driving on a state highway. never pull in to a gas station with it on. if you get caught with it on you will pay a hefty fine. this state is out to get my wallet.
